Surviving spouses need to know their rights after the death of their spouse.  Every state provides that surviving spouses receive benefits from the estate of the deceased spouse, no matter what the will might otherwise say.  In some states, the surviving spouse is protected through the concept of elective share.  In other states, the community property laws protect surviving spouses.
